General Terms and Conditions (GTC)
1. Scope of Application
These terms and conditions apply to the provision of apartments for accommodation as well as all other services provided by the provider (Château d’Esprit) to the guest.
2. Conclusion of Contract
The contract is concluded upon the provider’s acceptance of the guest’s application. The provider is free to confirm the booking in writing (via email). The contracting parties are the provider and the guest.
3. Services, Prices, and Payment

The provider is obliged to hold the apartment booked by the guest ready and to provide the agreed services.

The guest is obliged to pay the provider’s applicable prices for the provision of the apartment and any other services utilized.

The agreed prices include the respective statutory Value Added Tax (VAT).

Payment is made via advance payment (Instant Transfer or PayPal) during the booking process through the booking system on the website www.chateau-esprit.de.
4. Cancellation by the Guest (Withdrawal)

Any withdrawal by the guest from the contract concluded with the provider must be made in text form (email).

In the event of cancellation, the following flat-rate compensation charges apply:

Up to 14 days before arrival: Free of charge.

14 to 7 days before arrival: 50% of the total price.

Less than 7 days before arrival or no-show: 100% of the accommodation price. The cleaning fee will be refunded via the payment method used during booking.

The provider will make an effort to re-rent the apartment in the event of a cancellation. If successful, the compensation fee will be waived for the days of re-rental (minus a processing fee of €25).
5. Arrival and Departure

The apartment is available to the guest from 3:00 PM on the day of arrival. There is no entitlement to earlier availability.

On the day of departure, the apartment must be vacated and returned to the provider by 10:00 AM at the latest.
6. House Rules and Liability

Non-Smoking: All apartments are non-smoking areas. Smoking is only permitted on balconies/terraces. In the event of a violation, a cleaning fee of €150 will be charged.

Pets: Pets are not permitted out of consideration for allergy sufferers.

Damages: The guest is liable for all damages to the inventory or the building caused by them or their accompanying persons.

Keys: In the event of loss of the key (or damage to the locking mechanism), the guest is liable for the costs of restoration.
7. Final Provisions

Amendments or supplements to the contract should be made in text form.

The law of the Federal Republic of Germany shall apply. The place of performance and payment is the registered office of the provider.
8. Online Dispute Resolution
The European Commission provides a platform for Online Dispute Resolution (ODR): https://ec.europa.eu/consumers/odr. We are not obliged to participate in a dispute resolution procedure before a consumer arbitration board.
9. Right of Withdrawal
According to § 312g para. 2 no. 9 BGB (German Civil Code), there is no right of withdrawal for contracts concerning the provision of services in connection with accommodation activities for purposes other than residential use, if the contract provides for a specific date or period of performance.
